The buyer: Polish Coffee Corporation & the seller: J.J. Darboven Poland, than a subsidiary of J.J.Darboven Hamburg signed three contracts for delivery of:
• 50 Mt of Robusta Cameroon Grade2
• 100 Mt of Vietnam Robusta Grade2
• 100 Mt of Vietnam Robusta Grade1.

Soon after signing contracts the coffee market skyrocketed.

J.J. Darboven Poland defaulted on all the three contracts.
In a meantime, J.J. Darboven Poland, subsidiary of J.J.Darboven Hamburg, offered the same coffee at much higher prices to Prima S.A - the same coffee roaster to whom Polish Coffee Corporation originally sold the coffee contracted from J.J. Darboven Poland. As result of this default and as per the contract terms and conditions, Polish Coffee Corporation took J.J.Darboven Poland to the arbitration.

On December 6, 1994, The Deutschen Kaffee Verbandes e. V. ruled:
J.J. Darboven Poland, the subsidiary of J.J.Darboven Hamburg, DEFAULTED on all three contracts and has to pay Polish Coffee Corporation sp. z o.o. the penalty of $80,100, plus costs of the arbitration.

J. J. Darboven Poland BLACKLISTED
Despite the clear ruling of the Deutschen Kaffee Verbandes e. V., JJ Darboven Poland the subsidiary of JJ Darboven Hamburg, never paid the penalty and fees. As a result of that on 09 of May 2000, JJ Darboven Poland was BLACKLISTED by European Coffee Federation as a defaulting company!
On January 2003, the HANSEATISCHES OBERLANDESGERICHT (Higher Regional Court in Hamburg) confirms the previous ruling of the Deutschen Kaffee Verbandes e. V., making it a legal tender in pursue for collection of default on payment.
Neither JJ Darboven Hamburg nor JJ Darboven Poland ever disputed the result of Deutschen Kaffee Verbandes e. V ruling. Instead, they lawyered up and successfully fought every attempt Polish Coffee Corporation tried to execute the arbitration and court orders.
Till this date JJ Darboven Poland did not obey the rule of law.
Sadly JJ Darboven Poland currently owed and managed by JJ Darboven Hamburg to this day did not obey the rules of neither Deutschen Kaffee Verbandes e. V. nor the Court of HANSEATISCHES OBERLANDESGERICHT (Higher Regional Court in Hamburg).
